Terms of Service — NS Pulse

These Terms of Service ("Terms") govern your access to and use of the nspulse.ca website and the services provided by NS Pulse ("we," "us," or "our"). By submitting an inquiry, requesting a free trial, or engaging NS Pulse for services, you agree to these Terms.

1. Services Overview

NS Pulse provides services to trade contractors and local businesses in Nova Scotia (the "Services"), including:

Local SEO optimization
Google Business Profile management and Google Maps optimization
Digital reputation strategy
Automated SMS and email review request campaigns

2. Lead Submissions and 14-Day Free Trials

Submitting an inquiry or trial request does not guarantee acceptance. All service agreements depend on capacity, qualification, and signing a trial or retainer agreement. We may decline any request at our discretion.

During an approved 14-day free trial, NS Pulse sends automated review requests to a limited batch of the client's past customer contacts. Trial scope, contact limits, and timing are set out in the trial agreement. No payment is required for the trial, and there is no obligation to continue after it ends.

3. Client Responsibilities and Data Compliance

Clients guarantee that every customer contact list provided to NS Pulse is made up of legitimate past customers with whom the client has an existing business relationship.
Clients warrant that the customer data they provide complies with applicable privacy and anti-spam laws, including PIPEDA and CASL, and that sending a post-service review request does not go against any customer's stated preferences.
Clients will tell NS Pulse promptly about any opt-out, complaint, or data request from their customers.
Clients are responsible for the accuracy of the business information they provide.

4. Content and Ethical Review Standards

NS Pulse has a strict policy against fake, purchased, incentivized, or deceptive reviews. Our automation only asks real past customers for honest feedback on official review platforms, such as Google Maps. We do not write, post, filter, or buy reviews.

We may suspend or terminate service right away for any business that engages in fraudulent practices, illegal operations, review manipulation, or deceptive advertising.

5. Fees, Billing and Retainer Terms

Ongoing retainer services, such as monthly optimization and review engine management, are billed in advance for each agreed billing cycle.
Either party may cancel a retainer with written notice to info@nspulse.ca. Cancellation takes effect at the end of the current paid billing cycle unless the service agreement says otherwise. No partial-month refunds are issued.
Software and setup fees are non-refundable once campaign setup has started.
Unpaid balances may lead to services being suspended.

6. Disclaimers

The Services are provided on an "as is" and "as available" basis. NS Pulse works to improve local search visibility and review collection, but we do not control third-party platforms such as Google. We cannot guarantee specific ranking positions, a set number of reviews, or that third-party platforms will keep reviews permanently. Platform policies and algorithms can change at any time.

7. Limitation of Liability

To the fullest extent permitted by law, NS Pulse's total liability for any claim relating to the Services is limited to the amount the client paid for the specific service in question. NS Pulse is not liable for any indirect, incidental, special, or consequential damages, including lost profits, lost revenue, or loss of data.

8. Intellectual Property

All proprietary workflows, automation templates, website content, and software configurations remain the property of NS Pulse. Clients keep ownership of their business names, logos, and customer data, and grant NS Pulse a limited license to use them only to deliver the Services.

9. Changes to These Terms

We may update these Terms from time to time. The latest version will be posted on this page with an updated date. Continued use of the Services after changes means you accept the revised Terms.

10. Governing Law and Jurisdiction

These Terms are governed by the laws of the Province of Nova Scotia and the federal laws of Canada applicable therein. Any disputes will be resolved in the courts of Nova Scotia.
